Wills and Trusts
A will is a document used to provide directions about the disposition of your property after you die. A trust is a document that provides for the on-going management and eventual transfer of a person's property. A will can include a trust, but a trust included in a will only takes effect when a person dies. A trust created during your lifetime, however, gives you control over your property while you are alive and well and allows you to plan for yourself and your family if you become disabled. Establishing a will or trust allows you to provide guidance to your family about your wishes and may avoid family disputes at the time of your death. If you pass away without a will or a trust, Utah law will determine who receives your property and the conditions under which they receive it, which may not be at all what you would have chosen with proper counseling.
Common concerns that people have are protecting their assets and minimizing estate tax implications for their loved ones. There are many different types of trusts available, including special needs trusts, insurance trusts, revocable and irrevocable trusts, and charitable trusts that can help you ensure that your estate is managed in accordance with your wishes.
